The Appellant above-named being aggrieved by and dissatisfied with the Judgment dated [DATE REDACTED] passed by the Court of VIIth Senior Civil Judge, Karachi (Central) in Civil Suit No. [REDACTED]/2024 dismissing the suit of the Appellant for Declaration and Correction in Order VII Rule 11, which prays that this Honourable Court after calling for the record and proceedings of the said Civil Suit No. [REDACTED]/2024 from the said Court of VIIth Senior Civil Judge, Karachi (Central) and after hearing the counsel for the Appellant as well as after appreciating the facts and grounds detailed hereunder, be pleased to set-aside the said impugned order under Order VII Rule 11, dated [DATE REDACTED] and Decree/order the Appeal of the Appellant and/or to pass such other relief deemed fit and proper in the circumstances of the case.

F A C T S

That the Appellant filed a Suit No.1605 of 2019 in the Court of VIIth Senior Civil Judge, Karachi (Central) for Declaration and Correction of Name and Date of Birth against the Respondents.

That the name of Appellant is [REDACTED] son of 5 [REDACTED] and actual correct date of birth of the plaintiff is [DATE REDACTED] as in CNIC whereas the date of birth of the plaintiff is wrongly/mistakenly written as [DATE REDACTED] in his Secondary School certificate Examination, 2014 Roll No. [REDACTED].

That the correct name of the Appellant is [REDACTED] which is wrongly written as Syed Rub Basit Hussian Naqvi in his Secondary School certificate.
